Terms & Conditions

The rules of engagement, in plain English. Last updated 25 September 2026.

These Terms govern all services provided by Mack Media Co., Ltd. (registered in the Kingdom of Thailand, registration number 0105567080564), trading as Dopamine Digital ("we", "us"), to you, the client ("you"). By engaging us, whether by signed proposal, email confirmation or paid invoice, you agree to these Terms.

1. Scope of services

We design, build, maintain and automate websites, web applications, dashboards and messaging bots, and provide related advisory services (AI consultation, SEO, ads, tracking, content). We do not provide legal, tax or financial advice. We do not guarantee search rankings, ad performance or business outcomes, though we do our best work and report honestly. We do not store card data; payments are processed by a payment provider or a bank.

2. Project lifecycle

  1. Discovery: a 15-minute call or WhatsApp exchange to scope the work.
  2. Demo or proposal: a live demo site and/or written proposal, usually within 48 to 72 hours, at no cost and with no obligation.
  3. Agreement: you accept by signed proposal, written confirmation or by paying the deposit invoice.
  4. Build: design, development, copy and integrations.
  5. Review: one round of consolidated feedback is included in every fixed-price build. Additional rounds are billed at €90 per hour.
  6. Launch: deployment to your domain and handover.
  7. Management (optional): the monthly plan described in section 4.

3. Payment terms

One-time builds: 50% of the quoted fee on acceptance (the deposit, non-refundable once work starts) and 50% on launch, before deployment to your production domain. Invoices are due 7 days from issue.

Monthly plans: billed in advance on the 1st of each month, with 30 days' notice to cancel (section 8).

Currency and taxes: fees are invoiced in euro unless agreed otherwise. Taxes are charged in accordance with the law applicable to the invoicing entity; for B2B clients in the EU the reverse charge may apply, and each client is responsible for accounting for VAT in its own jurisdiction. Overdue invoices accrue interest at 8% per year, compounded monthly, and may result in paused work until cleared.

4. Management plan

The €150 a month Care plan includes hosting and domain management, weekly backups and uptime monitoring, unlimited small edits (up to about 15 minutes each and about two hours a month) and same-day response on working days. It does not include redesigns, new page templates, new integrations, bot training or ad management, which are quoted separately. Other plans are described on the pricing page and in your proposal.

5. Intellectual property

You retain ownership of all content, trademarks and brand assets you provide, and warrant that you have the right to use them. On full payment you own the final delivered work: the design, the code and the content written for your site. We retain ownership of our pre-existing tools, frameworks and component libraries and grant you a perpetual, non-exclusive licence to use them as part of the delivered site. Unless a written NDA applies, we may list you as a client and show screenshots and short case studies; tell us in writing if you would rather we did not. Third-party fonts, plugins, icons, stock photography and APIs carry their own licences, and we flag any that need ongoing fees.

6. Your responsibilities

Provide brand assets, content and feedback promptly; review deliverables within 5 business days of each milestone (silence past that is treated as acceptance); maintain and pay for your own domain and third-party services unless a plan covers them; keep any credentials we share with you secure.

7. Limitation of liability

To the extent permitted by law, our total aggregate liability under any project is capped at the fees you paid in the 3 months preceding the claim. We are not liable for indirect, incidental or consequential loss or loss of profit, nor for third-party outages or downstream effects of platform changes. Nothing limits liability for fraud, wilful misconduct or liability that cannot be limited by law.

8. Termination

You may cancel a fixed-price build at any time; the deposit is non-refundable and work already invoiced remains payable. Monthly plans end with 30 days' written notice, with access and hosting maintained through the notice period. We may terminate immediately for non-payment beyond 30 days or for abusive, fraudulent or unlawful conduct, and will export your data and deliver any paid-for completed work. After termination we hand over credentials, files and repositories you own, wind down hosting under our accounts within 14 days, and retain financial records as the law requires.

9. Confidentiality, force majeure and warranty

Each party keeps the other's confidential information private and uses it only for the engagement; this survives termination. Neither party is liable for delay caused by events beyond reasonable control. We warrant that services will be performed with reasonable skill and care and will correct any material defect reported within 30 days of launch at no additional cost; we do not warrant that a site will be error-free, continuously available or produce any specific business result.

11. Disputes and governing law

First, we talk it out. If unresolved within 30 days, either party may refer the dispute to mediation. Failing that, disputes are resolved by the courts of the Kingdom of Thailand, with exclusive jurisdiction of the competent courts of Bangkok, and these Terms are governed by Thai law. Nothing in this clause deprives EU-resident consumers of mandatory protections under the law of their habitual residence.

12. Miscellaneous

These Terms plus the accepted proposal are the whole agreement. Amendments must be in writing. If a clause is unenforceable the rest still applies. Not enforcing a clause once does not waive future enforcement. You may not assign this agreement without our consent.
